Land Grants
In the state of Kentucky all title to land was originally vested with a state government, Virginia before 1792 and Kentucky after 1792. To have a clear title to a piece of land, you first had to receive a grant from the state government. The system varied over the years, but generally you obtained a warrant which entitled you to a given amount of land without necessarily specifying its exact location. Warrants could be had for military service, by purchase from the state government (later county government), through political influence, or by purchase or gift from another warrant holder. You then had a suitable piece of land surveyed. Sending the warrant and survey to a state land office, you eventually received a patent or grant, giving you legal title to the land.
There were complications. Sometimes two or more individuals claimed the same land. "Squatters" often settled land and successfully resisted efforts of the "legal" owner. Any defects in the warrant--survey--patent document trail could be used to invalidate title, as happened to Daniel Boone.
Over 100,000 acres was granted in Owsley County 1843-1985. The average size was 91 acres, but this statistic is distorted by a handful of large grants of 1,000 to 10,000 acres. The median size was 50 acres; half the grants were as large or larger and half were as small or smaller. Over half of these were made in the 1840's and 1850's. By 1860 the population was over 6,000 (about 3,000 in present-day Owsley) and most of the land had been claimed.
